Terms of Service
These Terms of Service govern your access to and use of the AuditPoint platform, including auditpoint.ai, careindex.ai, weighstation.io, and all associated products, reports, APIs, and services operated under the AuditPoint name. By accessing any AuditPoint property or purchasing any AuditPoint product, you agree to these Terms.
These Terms constitute a legally binding agreement between you ("User," "Buyer," or "you") and AuditPoint ("AuditPoint," "we," "us," or "our"). By accessing or using any AuditPoint platform, product, or service — including but not limited to auditpoint.ai, careindex.ai, weighstation.io, and any intelligence reports delivered via email or download — you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are accessing AuditPoint on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not access or use any AuditPoint property.
AuditPoint is an institutional data intelligence platform that assembles, normalizes, and scores publicly available federal regulatory data across multiple verticals. Current platform products include:
- CareIndex (careindex.ai) — post-acute care intelligence sourced from CMS, HCRIS, and Payroll-Based Journal federal datasets
- WeighStation (weighstation.io) — commercial carrier intelligence sourced from FMCSA federal datasets
- U.S. Banks (auditpoint.ai/banks) — banking institution intelligence sourced from FDIC and FFIEC federal datasets
AuditPoint products are intended for institutional use by professional buyers including private equity firms, lenders, insurers, law firms, operators, and other commercial entities. AuditPoint is not designed for consumer use and does not produce consumer reports as defined under the Fair Credit Reporting Act.
AuditPoint is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. AuditPoint products may not be used as a factor in determining any individual's eligibility for credit, insurance, employment, housing, or any other purpose governed by the FCRA.
All AuditPoint data products are sourced from publicly available federal regulatory datasets and are intended for institutional due diligence, commercial risk assessment, and business intelligence purposes only. The subjects of AuditPoint reports are commercial entities — facilities, carriers, and financial institutions — not individual consumers.
Users who believe AuditPoint data is being used in a manner inconsistent with this section should contact us immediately at inquiries@auditpoint.ai.
AuditPoint sources all data from named federal primary sources including CMS, HCRIS, Payroll-Based Journal, FMCSA, FDIC, and FFIEC. Data is ingested, normalized, and scored on a refresh schedule disclosed on the AuditPoint methodology page at auditpoint.ai/methodology.
Derived scores and classifications — including but not limited to the WeighStation Score, Bank Health Score, and CareIndex compliance tiers — are AuditPoint analytical outputs based on government inputs. They are not official government designations and are not endorsed by CMS, FMCSA, FDIC, FFIEC, or any other federal agency.
AuditPoint makes reasonable efforts to ensure data accuracy but cannot guarantee that all data is current, complete, or free of error. Federal source data may contain inaccuracies that are propagated into AuditPoint products. Users are responsible for independently verifying data before making material business decisions.
- Data vintages are disclosed per report and on the methodology page
- AuditPoint is not responsible for changes in federal source data that occur after the stated vintage date
- Scores and tiers reflect AuditPoint's analytical methodology, which is fully disclosed and subject to change
AuditPoint processes payments through Stripe, a third-party payment processor. All transactions are processed in U.S. dollars. Payment card charges will appear on your statement as AUDITPOINT.
By completing a purchase, you authorize AuditPoint to charge your payment method for the stated amount. All prices are listed in U.S. dollars and are exclusive of any applicable taxes, which are your responsibility.
For portfolio intelligence engagements requested via inquiries@auditpoint.ai, pricing is provided in writing prior to any charge. No payment is processed without explicit written confirmation from the buyer.
- Per-report purchases (WeighStation, CareIndex) are charged at the time of purchase
- Portfolio intelligence engagements are invoiced separately with agreed scope and pricing
- AuditPoint reserves the right to modify pricing at any time; changes do not affect confirmed purchases
Intelligence reports are delivered electronically to the email address provided at the time of purchase, typically within minutes of payment confirmation for automated products. Portfolio intelligence engagements are delivered within the timeframe agreed at the time of scope confirmation, typically within one business day.
AuditPoint is not responsible for delivery failures caused by incorrect email addresses, spam filters, or email system outages. If you have not received a purchased report within 30 minutes of payment confirmation, contact inquiries@auditpoint.ai with your order reference.
Due to the nature of digital intelligence products, all sales are final upon report delivery. AuditPoint does not issue refunds for delivered reports.
Exceptions are made at AuditPoint's sole discretion in cases where: (a) a report was not delivered due to a technical error on our part, (b) a report contained a material factual error not present in the underlying federal source data, or (c) a duplicate charge occurred due to a payment processing error.
Refund requests must be submitted to inquiries@auditpoint.ai within 10 business days of purchase with a description of the issue.
AuditPoint products are licensed for the following institutional uses:
- Internal due diligence and underwriting for investment, lending, or insurance decisions
- Portfolio monitoring and compliance review by the purchasing organization
- Legal and regulatory research by licensed attorneys and their clients
- Benchmarking and competitive analysis for operators in covered verticals
- Journalistic and academic research with appropriate source attribution
Reports are licensed to the purchasing organization and may be shared internally. Reports may not be resold, redistributed commercially, or published publicly without written permission from AuditPoint.
You may not use AuditPoint products or data for any of the following purposes:
- Any purpose governed by the FCRA, including consumer credit, employment screening, or tenant screening
- Harassment, intimidation, or targeting of individuals associated with covered entities
- Systematic scraping, bulk downloading, or database replication of AuditPoint content
- Resale or commercial redistribution of AuditPoint reports or derived data without written agreement
- Any use that violates applicable federal, state, or local law
- Training or fine-tuning machine learning models on AuditPoint content without written permission
AuditPoint reserves the right to terminate access for any user found to be in violation of these prohibitions without refund.
The AuditPoint platform, scoring methodologies, report formats, site design, and all derived analytical outputs are the intellectual property of AuditPoint. The underlying federal data sourced from CMS, FMCSA, FDIC, FFIEC, and other government agencies is in the public domain.
AuditPoint's assembly, normalization, scoring, and presentation of that data — including the WeighStation Score, Bank Health Score, CareIndex compliance tiers, and all report templates — constitutes original work protected by applicable intellectual property law.
Nothing in these Terms grants you ownership of any AuditPoint intellectual property. Purchase of a report grants a limited, non-exclusive, non-transferable license to use that report for permitted purposes as described in Section 08.
AuditPoint reports reflect federal source data as published by the relevant agency. If you believe a report contains data that is inaccurate relative to the federal source, contact us at inquiries@auditpoint.ai with the specific data point in question and supporting documentation. We will review and respond within 10 business days.
If the dispute concerns data held by a federal agency — for example, FMCSA carrier safety records or CMS inspection histories — AuditPoint will direct you to the appropriate agency dispute process. AuditPoint cannot alter federal source data and is not responsible for errors originating in federal datasets.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUDITPOINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR RELIANCE ON ANY AUDITPOINT PRODUCT OR SERVICE.
AUDITPOINT'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR ANY AUDITPOINT PRODUCT SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO AUDITPOINT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
AuditPoint intelligence products are analytical tools intended to supplement, not replace, independent professional judgment. Users who make material business decisions — including investment, lending, insurance, or legal decisions — based solely on AuditPoint data do so at their own risk.
You agree to indemnify, defend, and hold harmless AuditPoint and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising from or related to:
- Your use of AuditPoint products in violation of these Terms
- Your use of AuditPoint data for any FCRA-governed purpose
- Any violation of applicable law in connection with your use of AuditPoint products
- Your reliance on AuditPoint data without independent verification where such verification was reasonably available
These Terms serve as the master agreement for all AuditPoint platform products. Each vertical product may publish an addendum covering vertical-specific obligations, dispute processes, and data handling practices. In the event of a conflict between these Terms and a vertical addendum, the addendum governs for matters specific to that vertical.

AuditPoint reserves the right to modify these Terms at any time. Changes will be posted at auditpoint.ai/terms with an updated effective date. Your continued use of any AuditPoint property after the effective date of a modification constitutes acceptance of the revised Terms.
For material changes, AuditPoint will make reasonable efforts to notify subscribers via The Findings newsletter or direct email where contact information is available.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of AuditPoint products shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
Before initiating formal legal proceedings, you agree to attempt informal resolution by contacting AuditPoint at inquiries@auditpoint.ai with a written description of the dispute. AuditPoint will respond within 30 days. If the dispute is not resolved within 60 days of that notice, either party may pursue formal legal remedies.
